Introduction
Welcome to Crobbies. Before using the services of crobbies.com you must agree to the following terms and conditions. You must also agree to the rules and agreements that are found by clicking the hyperlinks found in this agreement.
We reserve the right to suspend or terminate any account that violates the user agreement. General Rules
While using this website, you may not participate in any of the following behaviors:
Fees
Creating a crobbies.com account is free. You may purchase items from other users without paying a fee to Crobbies.com. You may also post content in the forums, post articles, or participate in non-selling activities at no charge.
When selling an item you are subject to a listing fee and a percent of sale fee. Before listing an item, you must agree to the fees listed on the item listing confirmation page. Fees may go up or down from time to time, but we will always provide a 14 day notice before a fee change goes into effect. You are responsible for collecting any applicable sales tax when selling an item. Balance statements are created monthly. We will attempt to send you an invoice via e-mail when your balance is greater than or equal to $1.00. Statements are also available in the ‘my account’ section of the crobbies.com website. A balance is due 14 days after the month of the statement. A statement that is more than 30 days late is considered past due. When your balance of $1.00 or more is more than 30 days past due we may temporarily suspend your selling privileges until your account balance is paid in full. If your account balance is more than 90 days past due we may use other methods to collect payment including the use of collection agencies or retaining legal counsel. All fees and prices on crobbies.com are in U.S. Dollars. Promotional Fees
From time to time we will run promotions for a specific group of people that will grant them discounted fees for a period of time. If you do not fall within this group of people, you are still bound to all of the listing fees and percent of sale fees you have agreed to. For example: we occasionally may run a promotion for new users that grant them discounted fees for 3 months. If you have established your account previously to such a promotion, you are still bound to the regular fees of selling an item and will not qualify for the discount.
We reserve the right to grant fee discounts or refunds to users for any reason of our choosing. All fees and prices on crobbies.com are in U.S. Dollars. Credits & Refunds
In the event that a buyer does not actually pay for an item they have agreed to purchase, you are entitled to 100% credit on your listing fee and percent of sale fee. This credit will be applied to your Crobbies balance. If your balance is greater than $1.00 you may request a refund which will be applied to the credit card you have on file with us. In the event that you no longer have an active credit card on file with us you will waive your right to a refund and instead be issued a credit towards future balances. Refunds may take up to 30 days from the time of the request to post.
Content License
When posting content on crobbies.com you agree to grant us non-exclusive, royalty-free, worldwide, rights on the use of the copyright.
Liability
You will not hold Crobbies responsible for the action or inaction of its users. Crobbies has no way to verify the accuracy of information posted by our users. We do not guarantee a sellers ability to sell an item, or a buyers ability to pay for an item. We also have no control over and aren’t responsible for the safety, quality or legality of items that are sold using our listing services. We merely provide a means for communication between two parties. We do not participate in the transactions between buyers and sellers.
We do not participate in the exchange of money for goods. This is handled between the buyer and the seller when an item is purchased. We do not transfer legal ownership of items from a seller to a buyer. If we are found to be liable you agree that our liability shall be no more than the total amount of all seller fees you have been subject to and paid for since the incident in which we were found to be liable. Release
If you are in a dispute with another user(s) you agree to release Crobbies, LLC and all of our employees from any claims that may arise. If you are a California resident you agree to waive California Civil Code 1542.
Website Interference
You may not interfere with the proper functioning of the crobbies.com website. This includes but is not limited to:
Any attempts to interfere with the proper functioning of the crobbies.com website may result in Crobbies, LLC taking legal action against the offender. Privacy
We do not share your personal information with third parties. We do however cooperate and may divulge information to law enforcement agencies if we believe there is adequate reason to do so.
Website Outages
Like any website, crobbies.com may go down from time to time. If such an event occurs, we’ll make every attempt within our means to get the website up and running again. If an outage occurs we’ll extend the length or your listed items by the amount of time of the outage, if requested.
You agree to otherwise not hold crobbies.com responsible for any problems that may arise from our website being down. |
